On 16 May 2015, the European Commission released its Digital Single Market Strategy as a follow-up to the Digital Agenda for Europe that was adopted on 19 May 2010. The digital policy forms one of the seven pillars of the Europe 2020 strategy that has established g

rowth targets for the European Union to be achieved by the end of the decade. The digital strategy seeks to better exploit the potential of information and communication technology (ICT) to foster innovation, economic growth and advancement. The objective of a digital single market is to unite the fragmented national markets and, in general, create an EU internal market using an integrated and cooperative approach. The digital single market is thus seen as an ongoing progress in the establishment of a space in which the free circulation of goods, people, services and capital is guaranteed. Through it, individuals and businesses, regardless of where they are located, should be able to access and provide activities over the Internet within a framework that guarantees fair competition and a high level of protection for consumers and personal data.
While the programmes and rules seeking to establish a digital market framework are identifiable (harmonisation of e-commerce rules, improved digital access to goods and services, restrictions on geo-blocking, development of e-government, establishment of the DIGITISE-EU programme, review of rules on audio-visual media and copyright, etc.), the legal nature of the digital single market is provocative. Indeed, questions should be asked on its rightful place within the development of EU law. In this way, it can be determined whether it is only a beguiling method to mechanically extend the single market to the digital space, or whether it expresses a proper EU policy in favour of unleashing transversal focuses and principles and broaching sector-limited approaches.
